Terms and Conditions
1. Definitions
In these terms, the following definitions apply:
- Roof Radar: Provider of the platform
- User: any natural person (B2C) or legal entity (B2B) using the service
- Service: the platform and all related functionalities, including receiving housing matches
- Agreement: the agreement between Roof Radar and the User
- Matches: property listings provided through the platform
2. Applicability
These terms apply to all offers, services, and agreements of Roof Radar.
Deviations are only valid if agreed upon in writing.
Any terms and conditions of the User are expressly excluded.
3. The Service
Roof Radar provides a digital platform that collects and makes property listings available to Users.
The service is available for:
- Consumers (B2C): home seekers
- Professionals (B2B): such as real estate agents and other parties in the real estate or retail sector
Roof Radar makes reasonable efforts to provide relevant and up-to-date matches but does not guarantee completeness, availability, or accuracy.
4. Formation of the Agreement
The agreement is formed when the User registers or purchases a service.
Roof Radar reserves the right to refuse any request without stating reasons.
5. Use of the Service
The User shall use the service only for lawful purposes.
It is not permitted to:
- copy, resell, or commercially exploit data without permission
- disrupt the operation of the platform
- use automated scripts or bots without explicit permission
6. Fair Use Policy
To ensure service quality, a fair use policy applies.
Each user is limited to a maximum of 500 matches per week.
In case of exceeding this limit, Roof Radar reserves the right to:
- temporarily restrict access
- charge additional fees
- block the account in case of structural abuse
7. Fees and Payment
All fees are clearly communicated prior to entering into the agreement.
Prices are inclusive of VAT for consumers and exclusive of VAT for business users, unless stated otherwise.
Payment is made in advance, unless agreed otherwise.
In case of late payment, access to the service may be restricted or suspended.
8. Duration and Termination
Agreements are entered into for the agreed duration.
Consumers may have a statutory 14-day cooling-off period, where applicable.
Roof Radar may terminate the agreement in case of:
- breach of these terms
- misuse of the service
- failure to meet payment obligations
9. Liability
Roof Radar is not liable for:
- missed opportunities or deals
- inaccuracies in property information
- indirect damages
Total liability is limited to the amount paid by the User in the last 3 months.
10. Availability and Changes
Roof Radar aims to provide a properly functioning platform but does not guarantee uninterrupted availability.
Roof Radar may modify or improve the service and its functionalities.
11. Intellectual Property
All rights to the platform, data, and technology belong to Roof Radar.
Users are granted a limited, non-transferable right of use only.
12. Amendments to the Terms
Roof Radar may amend these terms.
Users will be informed of any changes.
If a User does not agree, they may terminate the agreement.
13. Governing Law
These terms are governed by the laws applicable in the place of establishment of Roof Radar.
Disputes shall be submitted to the competent court.
